Monsanto tries to skirt bellwether trials in Roundup MDL

A scant six weeks before the first bellwether case goes to trial alleging Monsanto failed to warn consumers that its weed killer Roundup contains an ingredient that has been linked to cancer, the company told the California federal judge overseeing the multidistrict litigation (MDL) that consumers’ failure to warn claims are preempted by federal insecticide law. Citing the Federal Insecticide, Fungicide, and Rodenticide Act, attorneys for Monsanto filed a motion for summary judgement claiming that the company cannot change its labeling or the formulation of its weed killer without approval from the Environmental Protection Agency (EPA). First Roundup trial in MDL will be split into two phases

The first three bellwether trials in a multidistrict litigation in the U.S. District Court for the Northern District of California blaming an ingredient in the weed killer Roundup for causing cancer will be split into two phases. The first phase of the trials will focus on whether the ingredient glyphosate caused the plaintiffs’ cancer and, if so, the second phase will proceed to determine Bayer’s liability. The order was handed down by U.S. District Judge Vince Chhabria, granting a request by Bayer to separate the issues in the case of Edwin Hardeman. Bayer to lay off 12,000 employees, including a third in Monsanto division

Agra Pharma giant Bayer AG, which acquired Monsanto in June 2018, will lay off about 12,000 employees in the New Year, most of which will take place in Germany where the company is based. A third of those layoffs are expected to be in the Monsanto plant science division. The announcement was made in late November, just months after a California jury awarded $289 million to a school groundskeeper who sued Monsanto alleging exposure to the company’s Roundup weed killer contributed to his non-Hodgkin’s lymphoma diagnosis. Chemical linked to cancer found in most Americans’ bodies

Ninety-three percent of Americans have a probable cancer-causing chemical in their bodies, according to a first-of-its-kind comprehensive project conducted by the University of California. For the study, researchers collected urine samples on 131 individuals across the country, in both rural and urban environments, and found that the vast majority of their urine samples showed evidence of glyphosate, the active ingredient in Monsanto’s weed killer Roundup. Out-going IARC director reflects on fallout of glyphosate cancer declaration

Christopher Wild is stepping down as director for the World Health Organization’s International Agency for Research on Cancer (IARC) after serving two five-year terms guiding the organization in conducting and coordinating research into the causes of cancer. Lawsuit knocks Kellogg for not disclosing its breakfast foods contain glyphosate

California resident Mason Kein is leading a group of angry consumers in a proposed class action lawsuit against Kellogg Co. for selling breakfast foods without revealing that they contain a possible cancer-causing chemical. Monsanto is appealing a multimillion-dollar verdict blaming its weed killers Roundup and Ranger Pro for causing a school groundskeeper’s terminal cancer.
